This book is a translation of Petrus Hispanus' 13th century text.

The ArgumentIt is well known that theTractatusof Peter of Spain (later Pope John XXI) was one of the most popular logic textbooks in the Middle Ages and early Renaissance. Less known is theTractatus'sconsiderable reputation and diffusion among the Jews, as evidenced by five translations, two commentaries, and what appears to be anabbreviatio— if not of theTractatusitself, then of a similar work. The present article attempts to understand the phenomenon of theTractatus'spopularity and offers an analysis of the three translations whose (...) authors are known — those by Shemaryah ha-Ikriti (Greece, early to mid-fourteenth century), Abraham Abigdor (late fourteenth century), and Judah b. Samuel Shalom (either Italy or Spain, mid-fifteenth century) — and their subsequent fate. The more popular versions of Abraham Abidgor and Judah Shalom provided Jewish students, many of whom would likely become physicians, with a grounding in logic comparable to that of their Christian counterparts. The Seventh Quarry Press, 2019. 133pp.“No interval but some event takes place.”(Norris, “Freeze-Frame,” A Partial Truth)A Partial Truth, a collection of thirty-seven pieces, is the seventh volume of poetry by philosopher and literary theorist Christopher Norris. Nobody familiar with Norris’s distinguished career will be surprised to learn that his recent turn to versification (...) is not a repudiation of intellectual and rhetorical seriousness, but a re-emphasis of the same using resources not typically found in academic prose. Norris, an interdisciplinarian long before that term became a slogan, has in his work clocked up considerable epistemological mileage across diverse terrain, his critical friendship with deconstruction leading him to important interventions in analytic and Continental philosophy, institutional critique, philosophy of science and mathematics, legal studies, music, politics and, after all, creative criticism.Creative criticism is a relatively embryonic genre, until recently typified generally by a prose that owes a debt to Jacques Derrida’s Cir-confession, Glas and La carte postale. This is a style that foregrounds the philosophical unsaid – the repressed autobiographical, desirous, and otherwise messy constituents of that canon. It does so in part by jettisoning the academic politesse, and let’s say timidity, which help maintain such statutes of limitation. In a more specific way, creative criticism may be understood as a Romantic development set in train by the “Yale School” of deconstruction and its fellow travelers, straining in their own ways against the subordinate role of the reader and critic instituted by the likes of Matthew Arnold and T. S. Eliot.In the foreword to his 2017 volume The Winnowing Fan, Norris at once compliments this “strong” critical rebelliousness (xii), and critiques its ecstatic, quasi-apocalyptic hubris, provisionally aligning his own creative criticism with the “poetic diction” (xxi) of eighteenth-century figures such as Dryden and Pope. It is an analogy with caveats – not least Norris’s stated allergy to the “air of arrogance” (Tempus-Fugitives ix) of [End Page 122] their heavily end-stopped tendentiousness – but one which schematizes a poetics that both carries a definite argument and could not make this argument otherwise than in a manner reliant on verse’s formal properties.Note, however, the fact that Norris takes his distance from both strong criticism and those eighteenth-century essayists on the grounds of their shared self-assurance. A steadier presiding influence is William Empson, whose enmity towards Eliotic New Criticism, which “fixes a prescriptive gulf between poetry and other kinds of discourse,” makes him a political forebear, dissenting from modern forms of literary historical doctrinalism, specifically “that whole anti-rationalist complex of ideas that made the discontinuity between poetic and non-poetic language into a shibboleth of aesthetic, ethical, and (though rarely advertised as such) socio-political principle” (Tempus-Fugitives xix–xx). Norris is no straightforward disciple of Empson – who regarded Derrida, and the other “horrible Frenchmen” Norris used to invite him to read, as “so very disgusting, in a simple moral or social way, that I cannot stomach them” (qtd. in Haffenden 52). And yet, one constant quality of both Norris’s verse and prose criticism is a welcome sobriety of explication when it comes to the more recondite or outright flamboyant enclaves of modern European thought.A Partial Truth, and Norris’s books of verse generally, are explicit in outlining the ways in which his poetry functions as a reaction to the diaristic, mumbling slackness of much contemporary poetry; but does his turn to verse also indicate some reaction to contemporary theory? A Partial Truth’s “Foreword,” with modesty, states that “[i]f these poems have any distinctive merit then it lies in the treatment of interesting ideas in a way that deploys certain formal means to draw out complexities and further implications that would lie beyond the reach of a prose rendition” (14). We will specify some of the relations between form and discursive complexity presently, but for now, it is worth suggesting that Norris’s commitment to verse forms of historically recognizable kinds forecloses from him the mealy-mouthed, argumentatively fugitive character of... Throughout its pages, a diverse community of authors explores the relationships among religious and spiritual traditions, human life, and care for the Earth. Defining religion as a language with which to grapple with meanings assigned to cultural values (xxi), this volume turns to the meanings that humans have historically placed on their relationship to the Earth within spiritual and religious frameworks. It further ponders how our religions and spiritual traditions reflect a relationship to the Earth that is conscious of the status of our planet's health today. Offering insights from Buddhism, Hinduism, Islam, Judaism, Eastern and Western Christianity, and indigenous perspectives, the authors reflect on new and old insights from within their tradition that speak to specific ecological issues. In part 2, the authors further draw out the socioecological implications of religious teachings. Melanie Harris argues that religious communities must open their eyes to the link between structural violence against black women to structural violence against the Earth. She maintains that this analysis is key to finding solutions for ecological reparations. When Harris argues that social justice is Earth justice, she is claiming that the dismantling of both white supremacy and colonial ecology go hand in hand.Part 3, titled "Ecological Commitment," highlights the specific contexts in which the relationship between religion and ecology are embedded. Myrna Perez Sheldon and Naomi Oreskes trace the entanglement of evangelical identity with the politics of scientific doubt. In response, they suggest a new framework for evangelical participation in environmental restoration that moves beyond a political identity that is chained to right-wing doubt about climate change. In asking how "Korean Christianity can become more Nature-conscious, Nature-related, and Nature-integrated," Yong Bum Park points to Chondogyo, a Korean indigenous religion (333). This tradition is shown to take seriously the ecological crisis as a "crisis of consciousness and conduct," encouraging religious people to foster a socioecological vision of restoration (333).Part 4, which provides examples of concrete visions and projects on the ground, ends with John Hart's reimagining of the Earth as a "common commons." The notion that the Earth is a sacred "common commons" of "interdependent, integral, evolving relational community" requires conversion in light of how religious people relate to the Earth today (437). According to this commons ethic, land should be "commonized and communalized" rather than rendered private property (476).I highly recommend this volume for teaching undergraduate and graduate courses that are exploring the intersection of religion and ecology, especially courses focusing on religious ethics. Though the breadth of this work might strike the reader as boundless, herein lies its strength, especially for teachers of Christian ethics. This resource broadens the conversation recently highlighted by Pope Francis in Laudato Si' beyond the Christian perspective on ecology. One of the unsolved problems for the historical and philosophical thought of Ukraine is the lack of reflection on the phenomenon of Ukrainian neo-Thomism. Today, there has not been reconstructed the history of this trend, which had been actively developing in the interwar Western Ukraine since the time of socio-ethical letters by Andrei Sheptytsky in the early XX century, gained new connotations in the diaspora from 1940s to 1990s and acquired new forms in Roman Catholic thought in Ukraine at the (...) beginning of the XXI century. Moreover, a comprehensive historical and philosophical assessment of the achievements and shortcomings of Ukrainian neo-Thomism at different stages of its development has not been made. Meanwhile, Ukrainian neo-Thomism is experiencing a crisis, which it is trying to overcome by translating controversial works devoted mainly to the history of moral theology. The main feature of the proposed works is the oscillation between the need to recognize the presence of a person’s spiritual-intellectual and moral-volitional intuitions and the reluctance to recognize it openly, because it would be contrary to the very principles of Thomism. Modern Ukrainian neo-Thomism inherits this contradiction, and therefore the choice of classic books for translation reflects the dialectic of the struggle of different tendencies, which objectively cannot contribute to the legitimization of neo-Thomism in the Ukrainian philosophical discourse. Especially significant in this regard was the translation of the book by the classic of Polish neo-Thomism Mieczysław Krąmpiec “Why evil?”, because this monograph shows the contradiction of neo-Thomistic thought in the key issues about the possibility of person’s moral intuition, moral responsibility and dignity. The very refusal of Krąmpiec to recognize the existence of a person’s spiritual-intellectual and moral-volitional intuitions, despite all the prerequisites for such recognition, leads the monograph Why evil? to failure and to inability to answer the question stated in the title of the monograph. All this justifies that in the time of Pope Benedict XVI and Pope Francis moral theology and social doctrine moved to neo-Augustinianism, which unequivocally recognizes that the person has spiritual-intellectual and moral-volitional intuitions. We contribute to the literature on ethics in the professions by theorizing how global mobility precipitates professional insecurity and constrained moral agency. We present our findings of a study of accountants migrating to Canada. Using postcolonial theory and relational/poststructuralist theories of identity and ethics, we contrast the experiences of marginalized and privileged migrant accountants to show how those with “diverse” social identities are not recognized by professionals in Canada and must seek recognition from Canadian colleagues, employers, and clients to reconstitute (...) their professional identities and moral agency. We discuss the implications of the exclusion and marginalization of professionals for migrants, the profession, and society more generally. (shrink)

Understanding the nature of science has long been a desired outcome of science education, despite ongoing disagreements about the content, structure, and focus of NOS expectations. Addressing the concern that teachers likely focus only on student learning expectations appearing in standards documents, this study examines the current state of NOS in science education standards documents from nine diverse countries to determine the overt NOS learning expectations that appeared, NOS statements provided near those learning expectations, but not identified as learning outcomes, (...) and NOS statements found in ancillary text. Findings indicate that NOS ideas rarely occur as expectations for student learning and are far more commonly found in ancillary material. Moreover, consensus was not apparent in the overt learning outcomes for students. Given the well-documented poor state of NOS instruction and the consistent lack of NOS appearing in published curriculum materials, the NOS standards appearing in nearly all documents analyzed are unlikely to provide sufficient conceptual or pedagogical support for NOS to be accurately interpreted or translated into meaningful experiences for students. There is little empirical evidence showing a direct link between a capacity for statistical learning (SL) and proficiency with natural language. Moreover, discussion of the role of SL in language acquisition has seldom focused on literacy development. Our study addressed these issues by investigating the relationship between SL and reading ability in typically developing children and healthy adults. We tested SL using visually presented stimuli within a triplet learning paradigm and examined reading ability by administering the Wide Range Achievement Test (...) (WRAT-4; Wilkinson & Robertson, 2006). A total of 38 typically developing children (mean age of 9;5 years, range 6;4–12;5) and 37 healthy adults (mean age of 21 years, range 18–34) were assessed. In children, SL was significantly related to reading ability. Importantly, this relationship was independent of grade and also age. The adult data, too, revealed that SL was significantly related to reading ability. A regression analysis of the combined child and adult data revealed that SL accounted for a unique amount of variance in reading ability, after age and attention had been taken into consideration. For the first time, this study provides empirical evidence that a capacity for more effective SL is related to higher reading ability in the general population. (shrink)

The overwhelming weight of legal authority in the USA and Canada holds that consent is not required for brain death testing. The situation in England and Wales is similar but different. While clinicians in England and Wales may have a prima facie duty to obtain consent, lack of consent has not barred testing. In three recent cases where consent for brain death testing was formally presented to the court, lack of consent was not determinative, and in one case the court (...) questioned whether the clinicians were even required to seek consent from the parents of a child at all. The frontispiece of Hobbes's Leviathan is justly renowned as a powerful visual advertisement for his political philosophy. Consequently, its rich imagery has been the subject of extensive scholarly commentary. Surprisingly, then, its gendered dimensions have received relatively limited attention. This essay explores this neglected facet of the frontispiece. I argue that the image initially appears to present a hypermasculine sovereign. However, upon closer inspection, and considered alongside Hobbes's economic theory, it yields to a reading of the sovereign as an ambiguously (...) gendered figure. Reading the frontispiece through the prism of gender and the economy reveals not a static image of unwavering male power but rather one of an equivocally-sexed creature teeming with life, contradictions, and complexities worthy of continued examination. For the successful achievement of evidence-based practice, clinicians, managers and purchasers need evidence on whether a particular intervention works and ways to judge the appropriateness of the outcome criteria and measures used. Guidance is needed on what outcome measure to use, especially within routine clinical care settings. Beginning with a re-clarification of the difference between a health status and an outcome measure, the paper presents an evaluative checklist for use by clinical audit and research staff to review outcome measures for (...) use in routine care settings. Central features include the user-centredness of the measure, its psychometric properties, feasibility of use and utility. The applicability of the checklist is illustrated for outcome measurement in diabetes and stroke care. A modified form of the checklist is proposed for use by the busy clinician as an aid to the critical review of research papers within the context of evidence-based practice and to aid health care practitioners' choice of which outcome measure(s) to use within routine clinical care. Patients in the United States have been subject to an evergrowing “avalanche” of unwanted medical treatment. This is economically, ethically, and legally wrong. As one advocacy campaign puts it: “Patients should receive the medical treatments they want. Nothing less. Nothing more.” First, unwanted medical treatment constitutes waste (and often fraud or abuse) of scarce healthcare resources. Second, it is a serious violation of patients’ autonomy and self-determination. Third, but for a few rare exceptions, administering unwanted medical treatment contravenes settled legal (...) rules and principles. This “Legal Briefing” describes a central and growing role for the law. Specifically, courts and agencies have increasingly imposed penalties on healthcare providers who deliberately or negligently disregard advance directives and DNR (donot-resuscitate) orders. This address uses the question “Is business ethics getting better?” as a heuristic for discussing the importance of history in understanding business and ethics. The paper uses a number of examples to illustrate how the same ethical problems in business have been around for a long time. It describes early attempts at the Harvard Business School to use business history as a means of teaching students about moral and social values. Since there are so few controls over detecting and preventing faculty misconduct, one of the most common ways in which it is discovered is through student reports. Given the importance of student reports in bringing to light faculty’s ethical lapses, this paper seeks to understand what factors influence students’ likelihood to report faculty misconduct. We develop an empirical model that integrates the decision process of the Prosocial Organizational Behavior Model with insights from the emotional perspective on whistleblowing. Specifically, we use (...) an experimental survey to examine how students’ perceived unfairness of the faculty misconduct, feelings of anger, and the students’ self-interest in the situation in conjunction with situational “cues for inaction” lead to the intention to blow the whistle. Overall, the results from our structural model partially support our theoretical model. Interestingly, these findings demonstrate that, in the case of faculty member misconduct, anger and perceptions of unfairness play a greater role than the more rational cost-benefit process of the POB model. These results could aid in development of ethics education for students and could also inform the development of university policies that encourage students to come forward when faced with faculty misconduct. This article explores the notion of the unconscious (das Unbewusste) in terms of its nature and constitutive manifestations in consciousness. In contrast to the psychoanalytic formulation, the unconscious is conceptualized here distinctively as sedimentation (die Sedimentierung) within the Husserlian framework. All `experiences sediment and are “stored” in a darkened, affectless region of the psyche, which is nonetheless not in any sense separated from the sphere of consciousness. Rather, the sedimented experiences move dynamically between the unconscious and consciousness, constantly affecting and (...) manifesting in the upcoming conscious activities of the subject. Based on this conceptualization, I suggest a schematic understanding of the manifestations of the unconscious, or sedimentation, in consciousness. The conceptual division of consciousness into the sphere of understanding (Verstandessphäre), sphere of affect (Gemütssphäre) and sphere of volition (Willenssphäre) allows us to speak of the corresponding threefold manifestations of the unconscious in each of these spheres as type (Typus), mood (Stimmung) and habits (Habitus). Having their genetic “origin” in sedimented experiences, these structural moments play a constitutive role in upcoming conscious activities of the intentional subject. Furthermore, I demonstrate that each of these moments is characterized by a distinctive kind of horizonality, in light of which a deepened understanding of the genetic concept of horizon-consciousness (Horizontbewusstsein) is obtained. Despite the conceptual tripartition, I emphasize at the end the essential intertwinement of the three structural moments in such conscious performance as association. (shrink)

Environmental journalism has been criticized by various special interest groups and some editors for advocacy and faulted for inaccuracies. Sources, in turn, many from the science communities, have been accused of inaccessibility, and public relations representatiws from both industry and environmental organizations are regularly blamed for unethical behaviors rangingfrom hyperbole to more serious discussion or omission of factual information. This article reports a preliminary study of ethical decision making among members of the Society of Environmental Journalists, identifying ethical motivation diljerences (...) using the Ethical Motivation Scale. This is so because his moral system is based on the crucial idea that nothing in the world can be called "good without qualification except a good will."1 Thus a good will is good in and of itself, without regard to any possible end. For such a will, morality is categorical, for (...) only with such an imperative can moral laws be said to be laws ofcomplete freedom, and willed without regard to any other interest. Thus autonomy is a necessary condition for a good will, because any heteronomous worth a will could achieve would by definition be conditional, and would therefore violate Kant's notion of the unconditional worth of a good will. However, it is precisely this notion of the absolute worth a good will merits on its own that would seem to bear looking into: there is something intuitively wrong with Kant's assertion that even if"it should happen that, by a particularly unfortunate fate or by the niggardly provision of a stepmotherly nature, this will should be wholly lacking in power to accomplish its purpose," it would still "sparkle like a jewel in its own right, as something that had its full worth in itselP (p. 10). The idea implied in this passage, that a good will could exist somehow apart from the world and any effects achieved therein, is problematic to say the least. How could such a will be known? The metaphor ofa "sparklingjewel" is striking, but flawed: ajewel exists in the world, for all eyes to see if they know where to look, whereas a good will exists in the hearts of men. It is for this reason thatJoseph Conrad's LordJim is a fitting supplement to understanding the implications of a Kantian view of morality, for the central concern of the novel is the moral ambiguity that results from our common obscurity ofvision into ourselves and those around us. Given this 57 58Philosophy and Literature ambiguity, which Kant recognizes when he says, "even the strictest examination can never lead us entirely behind the secret incentives, for, when moral worth is in question, it is not a matter of actions which one sees but ofdieir inner principles which one does not see" (p. 23). It seems then irresponsible still to maintain that the worth ofa good will is independent of the way of the world. Since it is evident that if results or other empirical factors are invalid tojudge intentions, then the only judge capable of assessing in advance what maxim is being acted upon is the moral agent; morality becomes a matter of strictly individual conscience or reason. The moral agent thus becomes romanticized, a lone figure needing no other guidance than that which his or her own reason can provide in order to lead a truly good life. LordJim challenges just such a conception of individualist or self-sufficient morality. Due to the essential ambiguity ofwhatjim himselfis, the novel is an extremely difficult one to read. This is further complicated by the fact that, after the first four chapters, the reader is never given an impersonal view ofJim, but instead Marlow's painstaking efforts to fit together the puzzle ofJim's character: "I don't pretend I understood him. The views he let me have of himself were like those glimpses through the shifting rents in a thick fog— bits of vivid and vanishing detail, giving no connected idea of the general aspect of a country... they were no good for purposes of orientation."2 Given this cloud of uncertainty, Jim remains an enigma from beginning to end. The reader is treated to various judgments ofhim during this time from a wide range of viewpoints which Marlow perhaps pursues in an effort to shed some light on the subject, but which nonetheless leave us in darkness because they all omit one factor or another. There is no Authority in this book. The facts ofJim's case are relatively straightforward: it is the interpretation of what lies behind them, ofJim's "inner principles," which is extraordinarily complex. Psychotherapy holds out the promise of help for people who are hurting and in need. It can save lives and change lives. In therapy, clients can find their strengths and sense of hope. They can change course toward a more meaningful and healthy life. They can confront loss, tragedy, hopelessness, and the end of life in ways that do not leave them numb or paralyzed. They can discover what brings them joy and what sustains them through hard times. They can (...) begin to trust, or to trust more wisely. They can learn new behaviors in therapy and how to teach themselves new behaviors after therapy ends. They can question what they always believed was a given. They can find out what matters most to them, and how to stop wasting time. They can become happier, or at least less miserable. They can become better able, as Freud noted, to love and to work. They can learn how to accept and love themselves just as they are and accept others who are different from them. Our ethics acknowledge and affirm our profession's responsibilities. This book was written to help strengthen, deepen, and inform ethical awareness and the sense of personal ethical responsibility. Its job is to help you hold onto the ideals-including ethical ideals-that called you into the profession to begin with, to help you develop and fulfill those ideals. There will be so much-trust us on this-that tends to dull ethical awareness, to make ethics drift out of focus, to create barriers between you and your ideals, to replace ethics with pseudo-ethics and ethics placebos. The business and human rights movement shares several goals with the Benefit Corporation movement: corporations respecting human rights; maintaining a “wide aperture” so that all impacts of a company on people and communities are addressed; and creating rigorous standards of conduct and means of accountability. This paper argues that nonetheless the movements are traveling along parallel tracks and thus missing an opportunity for mutual learning that can improve their effectiveness. The BHR movement can look to B Corps for concrete examples (...) of viable companies that value human rights intrinsically and not just where there is a “business case” to do so. The B Impact Assessment, the B Corp certification tool, can better ensure that B Corps are in fact respecting human rights by adopting BHR standards. And both movements must give greater consideration to the potential contradiction between unlimited scaling—a key goal of B Corps—and the ability of large multinational corporations to respect human rights.
